Subject to the limitation of liability herein set forth, the company warrants that
the seeds or other merchandise sold are as described on the container, within recognized
tolerances. LIABILITY
ON THIS WARRANTY IS LIMITED TO THE PURCHASE PRICE OF THE SEEDS,
PLANTS OR OTHER MERCHANDISE.
In no event shall we be liable for the crop or
lack thereof, or for any loss due to negligence, or the failure, impairment, or quality of
the crop or varietal variance therein, whether such loss results from the breach of the
foregoing warranty, from breach of any other provision of the buyer's contract for the
purchase of said seeds, plants or other merchandise, or from any other cause.
SEEDLAND MAKES NO OTHER WARRANTY EITHER
EXPRESS OR IMPLIED AS TO MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OF SEED,
PLANTS OR
OTHER MERCHANDISE SOLD.
The seeds , plants and other merchandise are sold at the
price quoted only upon the condition that the above disclaimer of warranty and the
limitation of damages are part of the basis of that bargain and sale agreement.
Seeds or other merchandise not accepted under these terms should be returned within 20
days, in the original unopened container, and the Buyer will receive a refund of the
purchase price paid. Buyer may at his choice receive a "replacement" item of the
same merchandise or seed, providing that a replacement item is available.

| Arbitration-Conciliation-Mediation is
required by the laws of several different USA states. Under those various laws,
arbitration, mediation or conciliation is required as a prerequisite to maintaining a
legal action based upon the failure of seed, to which a notice such as this one is
attached, to produce as represented. The consumer
should file a complaint as required (sworn or signed) for those states where required
(i.e., currently: FL, IN, MS, SC, TX, WA, GA, CA, ID, ND, SD) along with the required
filing fee (where applicable), with the Commissioner/Director of the Secretary of
Agriculture or Seed Commissioner, or Chief Agricultural Officer of the specific state of
residence, within such time as to permit inspection of the crop, plants, or trees by the
designate agency and the Seed company from whom the seeds were
labeled and guaranteed by. A
copy of the complaint shall be sent to the seller by certified or registered mail, or as
other wise provided by state statue.
NOTE:
We reserve the right to cancel any orders for products or seeds in which either the
items are out of stock, no longer available or discontinued. On items in which the
pricing was listed incorrectly online due to an error in pricing correctly, we will
contact you with the corrected price. For our retail customers we
will offer you the wholesale price for that particular item,
however pricing errors will NOT be honored at the incorrect
"error" price. Sales are not completed & accepted until
payment is received or processed.
For added
security, we do NOT process credit card orders live
online. Your order is first reviewed by a sales specialist
for any changes, questions or corrections. After review your
order is then processed securely and items are scheduled for
shipment.

--- We will do our best to satisfactorily resolve
any problems that occur. The specific sale of our products and acceptance by you the customer requires
an agreement that any and all legal actions that may result as a part of any defect or
other occasion, must be filed in the home state and county of Seedland, Inc; I.E:
State of Florida. --- County of Suwannee County, Florida.
If a quality seed you purchase from Seedland.com does not
perform to your satisfaction, please send proof-of-purchase and empty
containers (bags, etc) with seed label attached with an
explanation of the problem to the manufacturer or to Seedland, Inc
by certified US Mail. Seedland
will act on your behalf to work with you in submitting your
complaint to the manufacturer.
Seller's damages are limited to the purchase price of the seed. Seller makes no
other warranty of merchantability or fitness for a particular purpose.
No refund or replacement will be made without proof of
purchase and container. Instructions are included on
most seed packages concerning refunds / guarantee
procedures. You may contact the manufacturer direct or
contact Seedland.com for assistance with your seed problem.

& PLANTS: Expected proper care by Customer |
Plants and seeds are live organisms. You must
use proper care for these items to insure that they continue to
establish, grow and flourish. Failure on the part of the
customer to observe correct planting and maintenance methods
(including watering, not planting within a reasonable time (60
days with seeds / 1 week with plants), planting using methods
not normally accepted by experts in the field, or not following
through with needed care after planting, will void any recourse
on the part of the customer toward their purchase from Seedland.
In all cases our liability is limited to the cost of
the seeds and/or plants (either refund or replacement). We
do not assume any liability toward additional costs you may
incur such as planting cost, delay in establishment time, or any
other loss due to the failure of the plants and/or seeds.
Obtaining a satisfactory result from seeds and / or
plants requires following correct growing procedures and proper
selection of both plants and location for planting. Many
factors can end up causing establishment problems, most of which
have nothing to do with the actual seeds and / or plants.
Consult with your local cooperative extension agent for
assistance in determining what may have contributed to any less
than satisfactory failure. |
